Le fou anglais eBay Terms & Conditions of Sale

1.PAYMENT

1.1 PLEASE NOTE : I ONLY ACCEPT DEBIT/CREDIT CARD PAYMENTS VIA PAYPAL, NOT DIRECTLY

1.2 All transactions through eBay (auctions, buy-it-now, or accepted offers) are binding contracts to purchase if you are the buyer/winner of the listing.

1.3 Payment is to be made through Paypal only unless agreed otherwise before bidding.

1.4 Under certain circumstances I can accept cash and cheques, but please contact me to discuss first.

1.5 Payment to be received within 3 days unless otherwise agreed before the listing ends.

1.6 If you later decide not to conclude the transaction then I will request the recovery of all eBay fees for that item. As a guide, eBay fees are generally around 5% of the transaction amount.

2. DELIVERY

2.1 PLEASE E-MAIL BEFORE THE AUCTION ENDS WITH YOUR POSTCODE FOR A FORMAL QUOTE FOR DELIVERY OUT OF THE BRISTOL DEPOT.

2.1.1 Delivery is either by myself personally, or through a specialist courier who are experienced at handling antiques goods. I do not make money on deliveries, and often subsidise the cost to keep the price down.

2.1.2. If you have not requested a delivery quote before the listing ends, a quote will be provided to you on the invoice. You will always have the option to collect or arrange your own courier subject to the terms of part 3.4 if you do not accept the quote provided.

2.2 For non-postal service items, delivery costs are the same regardless of whether you purchase one item or multiple items.

2.3 Upon receipt of the item, the delivery sign-off sheet must be signed by someone with the authority to check the condition and with the awareness to acknowledge that the item is as described at the time of sale.

3. COLLECTION

3.1 Collection is possible from a depot in Bristol.

3.2 Free collection is offered within 14 days of the end of the auction, otherwise additional charges will apply of £5 per week per item. The depot is open during normal office hours, although with some flexibility and is often open later.

3.2.1 If storage charges are due, payment can be made by Paypal or be paid in person on collection. Items will not be authorised for release if storage charges are due.

3.3 Under most circumstances items are deposited at the Bristol depot before being offered for sale, but on occasion they are listed before delivery to the UK. In that case, an approximate date of arrival in the Bristol depot will be on the listing. The 14 day free collection offer (3.2) starts from the date of arrival at the Bristol depot.

3.4 Collections by 3rd party couriers are accepted providing that the courier is responsible for packing, and carries insurance to cover the item if it is damaged in transit. The courier should check the item and note any damage at the point of collection - they will be asked to sign a collection receipt stating condition at the point of collection. I cannot be held responsible for damaged incurred during transit with a 3rd party courier.

4. RETURNS POLICY

4.1 Due to the nature of the items and delivery costs, returns are not generally accepted. However, if you genuinely feel that an item has been described inaccurately then you may return or reject the item at the point of delivery / collection only. Please make sure you have the authority and have checked the item on collection / delivery. If you sign the delivery notice and accept the item, you are acknowledging that it has been delivered as described. It is not permitted to write any comments on the delivery notice.  If you are unhappy with the piece, do not accept it and you will receive a refund.

4.2 The money back guarantee applies to pieces sold within the UK mainland only.

4.3 For items delivered by courier, a charge will be incurred to cover the cost of returned items.  Alternatively items can be returned to the depot in Bristol at the buyers cost providing all reasonable care is taken to ensure they arrive in the condition they were sold in.  Items must be insured for their full value during transit.  Damaged items will be liable for a charge to cover the cost of replacement or repair.

4.4 If you feel the item is not as described or damaged in transit, please call me at the time of delivery / collection to discuss the problem. If I am not available, you must ask the driver to call their office to discus the problem, they may also have additional contact details for myself. If I agree I have made a mistake and wrongly described something, or the item appears to have been damaged in transit, I will offer either a full refund including the delivery charge, or alternatively I may offer a partial refund in compensation and you can keep the item.

4.5 Items may be accepted back at a later date under certain circumstances (for example, the item turns out to be too big and you did not realise). You will however, remain liable for both the delivery cost to you and the cost of return. A full refund of the purchase cost of the piece will be made once the safe return of the item has been confirmed.

4.6 If you do not abide by the terms of the Returns Policy, then later file a Paypal dispute, and are successful in your claim, a County Court claim will be issued against you for the full amount of any losses incurred.

5. NON-PAYMENT

5.1 If no contact has been made within 7 days from the end of auction, items will automatically be relisted and non -paying bidder report filed. If you are unlikely to be around after the end of the auction (e.g. on holiday) please contact me beforehand to explain and I will hold the item for you.
